To the said NADEZHDA ZOSIM and VLADIMIR A. ZOSIM: NADEZHDA ZOSIM and VLADIMIR A. ZOSIM, wife and husband
You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to wit, within sixty days after September 20, 2013 (the date of first publication), and defend the above entitled action in the above entitled court, and answer the complaint of the plaintiff, MAPLECREST HOMEOWNERS’ ASSOCIATION, a Washington non-profit corporation (“Maplecrest”), and serve a copy of your answer upon the undersigned attorneys for plaintiff, Charles A. Isely, of Christel & Isely, LLP, Attorneys at Law at his or her office below stated; and in case of your failure so to do, judgment will be rendered against you according to the demand of the complaint, which has been filed with the clerk of said court.
This action has two purposes. The first purpose is to pursue a breach of contract action arising out of Defendants’ failure to pay assessments as required under the Declaration of Covenants, Conditions and Restrictions, recorded under Auditor’s File No. 3001972, in the records of Clark County, Washington (the “Declaration”). NADEZHDA ZOSIM and VLADIMIR A. ZOSIM are obligated to pay to Maplecrest the amounts accrued plus attorney fees and costs.
The second purpose of this action is to foreclose on the lien Maplecrest has against the real property located at 17702 NE 31st St., Vancouver, Washington 98682 in Clark County, WA. Such lien arises out of Defendants’ failure to pay assessments which are rightfully due and owing to Maplecrest under the Declaration.
